Rules of the Super Service Challenge

  1. Who is eligible: You must be a legal resident of one of the 50 United States or the District of Columbia, and at least eighteen (18) years of age to enter a video (the "Entrant") for the Super Service Challenge (the "Challenge"). You must either have a Super Service Challenge account, or log into the superservicechallenge.com website using your Facebook or Google account, to submit a video. Only 501(c)(3) tax exempt organizations with a current and valid tax U.S. Internal Revenue Service Determination Letter at the time the award is granted and who have a Super Service Challenge account (a "Non-Profit") are eligible to receive awards or other donations. Awards from the Challenge also require all of the following conditions to be met: (1) the Entrant and Non-Profit have complied with these Rules, including methods of entry, (2) voting was deemed to be fair by TrueU, and (3) TrueU reaches the Non-Profit by notice sent to the contact information in the Non-Profit's Super Service Challenge account within 60 days of determination of the prize award.
  2. Who is not eligible: You are not eligible to enter a Challenge video if you are: (i) an officer or employee of TrueU or an immediate family member of such person; (ii) any other person working on the Challenge during the campaign period; or (iii) the Non-Profit that is the subject of the Challenge video. Residents of any states where this contest would be prohibited by law are not eligible to win. Organizations that do not have a current 501(c)(3) Determination Letter from the U.S. Internal Revenue Service, or a Super Service Challenge account at the time the award is granted are not eligible. Check your local laws before entering. VOID WHERE PROHIBITED BY LAW.
  3. How to enter: There is no cost to participate. The contest is intended to be a fun way to inspire acts of service and to share the good works of nonprofit organizations. Videos that inform viewers about the charitable work of a Non-Profit may be submitted through the Entrant's Super Service Challenge account and must include at least two volunteers shown in the act of service. Videos must include a description of the service project, the name of the Non-Profit, and the impact of the Non-Profit's service and of the volunteer project that is the subject of the video. To enter, Entrants must select their Non-Profit from the Challenge website. If the entrant's desired Non-Profit is not registered with TrueU, the Entrant may nominate the Non-Profit through Super Service Challenge website. All Non-Profits must register with TrueU in order to receive an award. Non-Profits cannot post their own videos or vote for their own organization.
  4. Entry periods, award determination, and award amounts and delivery: Videos may be uploaded by an Entrant at any time. When submitting a video, Entrant must designate the length of time that the campaign for video votes will run. Campaigns may extend for up to 4 calendar quarters and must end on the last day of the final quarter. Awards are determined quarterly for campaigns designated to end in such quarter. Entrants may be limited at any time at the discretion of TrueU, in the number of videos that may be submitted and eligible for awards. Awards are based upon the number of votes received by the video featuring the Non-Profit, provided that, a video featuring an eligible Non-Profit must receive at least 50 votes by the end of the campaign before an award can be made. The total value of annual awards depends upon the number of eligible video submissions and votes. Any taxes on awards are the responsibility of Non-Profit. Awards will be paid by TrueU or its designee. In no event will any Non-Profit be eligible for more than $50,000 in awards or donations directly or indirectly from the Super Service Challenge in any calendar year. All awards are made in the form of a donation to the eligible Non-Profit featured in the video submission. Awards are non-transferrable prior to acceptance. If a Non-Profit declines an award, TrueU will not award an alternate. Award notices will be sent to the contact information in the Non-Profit's Super Service Challenge account. Only one award notice will be attempted. If the Non-Profit does not respond within the time period designated in the notice, the award may be forfeited.
  5. Voting: Voters must register with TrueU in order to be eligible to vote. A Voter is not required to submit a video in order to be eligible to vote. Voters are limited to one vote per video. TrueU reserves the right from time to time to offer voters with additional opportunities to vote on video submissions on the Super Service Challenge website. The use of automated voting, BOTs, or other unfair voting methods, as determined in the discretion of TrueU, is strictly prohibited and may lead to disqualification of the Entrant, the Non-Profit and/or voters.
  6. User Generated Content: Entrants own the videos that they upload to the Super Service Challenge website. TrueU does not prohibit Entrants from sharing their videos on other social media platforms at the Entrant's discretion. Upon the request of the Entrant or the designated Non-Profit, TrueU will remove a submitted video from the Super Service Challenge website. By submitting the video, the Entrant and Non-Profit agree that TrueU may use the video for its own promotions and other charitable purposes. TrueU cannot review all videos submitted. Entrants are responsible for the content of the submission and must ensure that:
    • all of the content in the video is original;
    • there are no false or defamatory statements in the video;
    • there is no obscene, pornographic or other inappropriate material in the video;
    • all individuals appearing in the video have agreed to appear in the video and are not asserting any rights of privacy relating to the video; and
    • nothing contained in the video infringes upon any copyright or other intellectual property right of another.
    By submitting a video, Entrant and Non-Profit agree that TrueU may distribute the video to third parties, including to TrueU's network of business partners, sponsors and other third parties.
  7. DMCA Policy: TrueU is not a Super Service Challenge video content provider and cannot review all submissions for possible copyright violations. TrueU does not directly financially benefit from Entrant's submissions. Entrants are required to affirm they own any materials submitted at the time of submission. If any person wishes to assert copyright claims as to a submission, they should send notice of alleged ownership rights to DMCA Claims Administrator, c/o True U, Inc., 3750 Priority Way South Drive, Indianapolis, Indiana 46240. TrueU will terminate any user's access if TrueU, in its sole and absolute discretion, determines a user has infringed upon the rights of a 3rd party.
  8. Entries not received: We are not responsible for computer, online, telephone, or technical malfunctions, Acts of God or human error that prevent or postpone receipt of an Entrant's video or the receipt or calculation of votes.
  9. Entrant's agreement: Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of TrueU, which are final and binding on all matters related to this contest. Entrant grants TrueU and Entrant's designated Non-Profit a worldwide, perpetual license to host, copy, transmit and display Entrant's video as necessary for TrueU to conduct the Challenge, for promoting the Challenge, and for any other purpose TrueU determines is reasonably necessary to support Entrant's Non-Profit. TrueU reserves the right to decide whether an Entrant's submission or any Voter's voting violate these Rules and if a submission includes prohibited content (See Section 6) or is of excessive length. TrueU may at any time, without prior notice and in its sole discretion, remove such submissions and/or terminate a user's account. TrueU also reserves the right to withhold, in its reasonable discretion, an award from a Non-Profit at any time for any reason.
  10. Signing documents: Winning Non-Profits may be required to sign an affidavit of eligibility, certain tax/government forms, and a release before receiving the award. If a Non-Profit elects not to sign our required documents, it will forfeit the award. All documents required to claim an award must be returned fully executed within 30 business days from receipt by the winning Non-Profit. Non-compliance within these obligations may result in disqualification. We are required by IRS Circular 230 to tell you that neither these Rules nor any other communication regarding this giveaway is written or communicated for the purpose of helping you avoid any penalties that may be imposed by federal tax law, and neither you nor any other affected taxpayer may use them that way.
  11. Entrant's release: (a) Entrants agree that any and all disputes, claims, and causes of action arising out of, or connected with, the contest or any prize shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court located in Marion County, Indiana; (b) any and all claims, judgments, and awards shall be limited to actual damages incurred as a direct result of entering Super Service Challenge, but in no event for attorney's fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entry hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages increased or multiplied. SOME JURISDICTIONS PROHIBIT EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO PORTIONS OF THE ABOVE MAY NOT APPLY TO YOU. All issues or questions concerning validity, construction, interpretation, or enforceability of these rules, Entrant's rights or obligations, or the rights or obligations of TrueU shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to any choice of law rules.
  12. Termination of Super Service Challenge: We reserve the right, at our sole discretion, to disqualify anyone who tampers with the entry process, and to cancel, terminate, modify, or suspend the Super Service Challenge if anything required for its conduct should malfunction or be deemed illegal. Should this contest be terminated prior to the end of any entry period, which we may do at our sole discretion, a notice will be posted on SuperServiceChallenge.com. We may terminate this contest at any time in our sole discretion.
  13. Laws and jurisdiction: United States and Indiana laws govern Super Service Challenge. NO PURCHASE NECESSARY TO ENTER. Product purchases or other interactions with True U, Inc. d/b/a Super Service will not increase your chances of winning. Awards are granted on the basis of vote totals. VOID WHERE PROHIBITED BY LAW. All disputes resulting in legal action shall be resolved in the state or federal courts having jurisdiction over Marion County, Indiana, and Entrant and Non-Profit consents to the exclusive jurisdiction of those courts. Should Super Service find it necessary to seek legal assistance to enforce its rights, it shall be entitled to recover its reasonable legal expenses and attorney's fees.
  14. When bad things happen: We assume no responsibility for anything that happens outside of our control, including events of force majeure, which delay or prevent your entry or otherwise affect or make the contest impossible.
  15. The sponsor/administrator: This contest is sponsored and administered by True U, Inc.dba Super Service Challenge (referred to herein as "Super Service"), 3750 Priority Way South Drive, Indianapolis, Indiana 46240.
  16. Privacy: Information collected from entrants is subject to the Privacy Policy that may be found at https://www.SuperServiceChallenge.com/privacy-policy.
